Right to be Forgotten

Under UK data protection legislation, you may have the right to request the deletion of personal information that LC Electrical Installations Ltd holds about you.

This is commonly referred to as the right to erasure or the right to be forgotten.

The right is not absolute and only applies in certain circumstances.

1. When you may request deletion

You may be entitled to ask us to erase your personal information where:

  • The information is no longer necessary for the purpose for which it was collected
  • You withdraw consent and there is no other lawful basis for processing the information
  • You object to processing based on legitimate interests and there are no overriding legitimate grounds for continuing

2. When we may need to retain information

There are circumstances where we may be unable to delete some or all of your information.

For example, we may need to retain information where processing is necessary:

  • To comply with a legal obligation
  • To maintain accounting or tax records
  • For the establishment, exercise or defence of legal claims
  • To maintain necessary records relating to work or services previously carried out
  • For certain public interest purposes permitted by law

If we are unable to comply fully with your request, we will explain the reason where we are legally permitted to do so.

4. Information we may need from you

To help us locate your information, please provide:

  • Your full name
  • Your email address
  • Your telephone number, where relevant
  • Your address, where relevant
  • Details of your relationship with LC Electrical Installations Ltd
  • A brief description of the information you would like deleted

We may request additional information where reasonably necessary to confirm your identity.

This is intended to ensure that personal information is not deleted or disclosed following a fraudulent request.

5. What happens after we receive your request?

We will review your request and determine whether the right to erasure applies.

Where the request is valid, we will take reasonable steps to delete the relevant personal information from our active systems.

Where information has been shared with a third party and we are required to do so, we will take reasonable steps to inform the relevant recipient of the erasure request.

Some information may remain temporarily within secure backup systems until those backups are overwritten in accordance with our normal retention procedures.

6. How long will it take?

We aim to respond to requests within the timescales required by UK data protection legislation.

Where a request is particularly complex, or where multiple requests have been made, the permitted response period may be extended. If this applies, we will inform you.

7. Is there a charge?

There is normally no charge for making a request.

However, in circumstances permitted by data protection legislation, we may charge a reasonable fee or refuse to act where a request is manifestly unfounded or excessive.

You may also have the right to make a complaint to the Information Commissioner’s Office (ICO).

One thing I would check before these go live is the exact email address. Your screenshot appears to show lewis@lcelectrical-instltd.co.uk, whereas the existing website indexed online shows lewis@lcelectrical-insltd.co.uk. I have used the latter above, but it should be confirmed.

Also, the Cookie Policy will be stronger if we populate it with the actual cookies installed on the site rather than leaving it category based. The ICO’s current guidance expects information including what the technologies do, any relevant third parties and how long information is stored or accessed.
